Conway Oldham

Nuncupative Will

Probate Court

January Term 1846

On Motion of H. J. [illegible, possibly Hamilton] the non Cupative will of Conway Oldham Dec'd was Presented to the Court and it being proven to the satisfaction of the Court that said will contained the express desires & wishes of the said Deceased in his last illness and while of sound mind and memory it was ordered by the Court that said will spread upon the Recorder of said court which said is in words and figures following (to wit)


The nuncupative will of Conway Oldham who died at his own dwelling house in the County of Coahoma and State of Mississippi on Friday the 2nd day of Jany AD 1846.  The following bequests made in presence of the undersigned witnesses on whom he called to hear evidence that the same was his will to wit


1st  I wish all my just debts to be paid.

2nd  I will to each of my own children twenty dollars save those hereafter mentioned.

3rd  I give to Louise Humphreys wife of John Humphreys one yoke of oxen and to William Oldham one yoke of oxen.

4th  I will and bequeath to my wife Mary Oldham all of the remainder of my estate during her life provided my two daughters Elizabeth Jane and Henrietta should live with her until her death and not marry.  In the event of marrying or separating from her it is my will and wish that the property be equally divided between my wife and my said two daughters.  The sorrel race mare [illegible - perhaps Brinnee] which I have if she proves to be in foal I wish to be kept a brood mare in the family; if not I wish her sold and the proceeds used pay my debts.  The third part of the property above spoken of being given to my wife in the even of separation or marriage of my daughters I give to her during her natural life, and at her death I wish it to be equally divided between my two daughters Elizabeth Jane and Henrietta aforesaid.

Lastly I wish it to be well understood that I made a will sometime in the year 1841 which I now revoke and will the same destroyed when found among my papers and I now renounce and revoke the same.

The above and foregoing will was made and we the undersigned were called to bear testimony to the same by Conway Oldham on his death bed at his own dwelling house in the County of Coahoma on the 2nd January AD 1846.

Given under hands this 5th day of January AD 1846. Sworn to and subscribed in open Court this 26th day of January 1846.
