In the name of God, Amen. I Daniel H. Applegate of the city, county and state of New York mindful of the uncertainties of this life do make this my last will and testament in manner and form as follows. That is to say

First it is my will and I do order that all my just debts and funeral expenses be paid as soon as possible after my decease.

Item: I order and direct that the sum of two hundred and fifty dollars be paid annually by my executor to my mother Eliza Applegate in semi annual payments during her natural life

Item: It is my will that my executor shall take charge of the real estate owned by my wife Mary Elizabeth at her decease and collect the rents and profits thereof during the minority of my children and use or invest the same for their benefit.

Item I give and bequeath unto my two children Abram W. Applegate and Mary E. Applegate all the rest and residue of my estate of whatsoever nature and wheresoever found in equal portions share and share alike to them and their heirs forever. And I hereby authorize and empower my executors hereinafter named to invest each ones portion thereof in Bonds and Mortgages or Real estate unencumbered where the land secures the amount of the mortgage independent of improvements thereupon. And I direct my executor to pay over to each child his or her portion after he or she shall obtain the age of twenty one years and before attaining the age of twenty five years at any time wherein the discretion of my executor he or she is completely and capable of prudently managing and taking care of the same And I further authorize my executor after either of my said children shall arrive at the age of maturity and before attaining the age of twenty five years to pay him or her any part of his or her portions as in his discretion he may deem wise and proper.

Item I order my executor to provide for my children during their respective minority and before he or she shall receive his or her portion of my estate a reasonable and sufficiently maintenance out of my estate.

Item It is my will that my executor hereby shall be vested with full authority to act as guardian of my said children for the purpose of carrying out the provisions of this will without being compelled to apply to the court for that purpose or to give bond

Item I hereby nominate and appoint John S. Applegate Counselor at Law of Red Bank New Jersey Executor of this my last will and testament.

In witness whereof I have hereunto set my hand and seal this sixth day of July Eighteen hundred and seventy two.
