1894-12-12 Will of Daniel D Applegate 5G1C2B1

In the name of God Amen. I Daniel D. Applegate of Dayton N.J. in the county of Middlesex and State of New Jersey being of sound mind and memory blessed be Almighty God for Same. I do make and publish this my last will and testament in manner and form following that is to say.

First it is my will and I do order that all of my just debts and funeral expenses be paid as soon as conveniently may be after my decease.

Second I give devise and bequeath unto my wife Roxanna Applegate and to her heirs and assigns forever the Farm where I now live purchased by me of James Mershone and wife also thirty eight acres more or less lying and being the township of South Brunswick State of New Jersey Thirty eight acres lying on the Road from Dayton to the Pigress Swamp, formerly the McDowell tract together with the household goods and furniture and the one team of horses or mules choice poultry and every thing when and about the said Farm all wagons except large log wagon.

Third I give devise and bequeath unto my Said Wife Roxanna Applegate and to her heirs and assigns forever the Sum of Two Thousand Dollars to be paid to her at my death

Fourth I direct my Executors hereafter named to invest in Some Safe Securities the Sum of Eight Thousand Dollars and to pay the yearly income there of to my said Wife Roxanna Applegate after deducting tax from same I do direct that the Said Sum of Eight Thousand Dollars becomes a part of my residuary estate and be disposed of at the death of my said Wife Roxanna Applegate I hereby bind my Executors to see that my Said Wife Roxanna get her interest yearly during her natural life From the Eight Thousand Dollars.

Fifth I do hereby direct that the Farm and Thirty Eight Acres herein before bequeathed to my Said Wife Roxanna Applegate shall be in Lieu of Dower

Sixth I give and bequeath unto Mathew Ashmon and his Wife for and during the term of their natural lives the use of the house Now Occupied by them together with five acres of land adjoining at their death I do direct that the Same become a part of my estate and be disposed of as hereinafter directed.

Seventh All the rest of residue and remainder of my Said estate both real personal and mixed whatsoever the same may be and wheresoever Situated except what money I have at my death in Bank or otherways this money my Son Wesley Applegate is to have full use during his Natural life for paying taxes and for the Support of his Family in any ways as may seem best to him and to have full charge of the Same at my Son Wesly Applegate death if there is any of this money left it must go to his heirs when they become one and twenty I give devise and bequeath unto my son Wesley Applegate to have and to hold the same for his heirs and assigns forever all the rest of my property real and personal.

Lastly I nominate and appoint my Said Wife Roxanna Applegate my Son Wesly Applegate and my Brother-in-law George Duncan executrix and executers of this my last will and testament hereby revoking All former wills by me made This my last will and testament contained one sheet of paper.

In witness whereof I have hereunto set my hand and seal this twelfth day of December Eighteen Hundred and Ninety Four in the year of Our Lord One Thousand Eight Hundred and Ninety Four on December the Twelfth.
