Daniel Applegate, Will, 1836
Recorded in Middlesex Records of Wills Lib D p. 105-107 by J. Kirkpatrick Surrogate

In the name of God, I, Daniel Applegaite of the township of South Amboy in the County of Middlesex in the State of New Jersey, being infirm and weak in body, but of a sound disposing mind and memory, do make this instrument my last will and testament. To wit:

First I do authorise direct and empower my executors hereinafter named to make sale of all my Real Estate in the County of Middlesex or elsewhere at either public or private sale as they may determine will yield the best price.

And as to my personal property I do authorize and direct my executors to sell the same to the best advantage at their reasonable discretion (excepting so much thereof as my beloved wife Eleanor may select and desire to retain for her comfort and convenience.)

and further I do order and direct my executors after making sale as aforeesaid with the monies arising from such sales to pay all just debts I owe and all necessary legal and just expenses: and to invest the balance of the monies arising from the aforesaid sales at Interest secured upon bonds & mortgages one third of the interest of which I do give and bequeath unto my wife, to be paid yearly, for her proper use and support as long as she lives and after her decease the principle with interest, if any, to be equally divided between my hereinafter named children

The said interest of one third of the balance monies after defraying the above named debts, given to and for my wife, is intended in lieu of her dower in my Real Estate and is so to be considered and accepted.

And also the Interest of the remaining two thirds to be applied towards the support of my Children Margaret Ann & Mary equally. But if said interest of the remaining two thirds of the residue of my estate shall be founded insufficient for the maintenance of their support I do hereby direct my executors to make use of so much of the principle as in their judgment and economy may be deemed sufficient.

And the principle sums do be equally divided between them, each to receive her share or equal proportion as they shall arrive to full age or to receive their shares at the time of marriage should either or both of them marry before twenty one year of age.

And lastly I do hereby appoint & constitute my wife Eleanor Applegaite and Samuel Dixon Executors of this my last will and testament

In witness whereof I have hereunto set my hand and seal this twenty eighth day of December in the year of out Lord one thousand eight hundred and thirty five.
