Will of Abijah Applegate

Middlesex County (NJ) Will Book 34, pp. 128-129


I, Abijah Applegate, of the Township of Madison, County of Middlesex and State of New Jersey, do make this my last will and testament in manner following, to wit:


First-  I direct all my just debts and my funeral expenses to be paid as soon as may be reasonable after my decease.


Second-  I give, devise and bequeath unto my wife, Adelaide Applegate, all of my estate, both real and personal, in whatever it may consist, to have, hold, receive, use and enjoy the rents issues and profits thereof during the term of her natural life, if she long remains my wido and from and after her decease, or her again marrying, I give, devise and bequeath my said estate unto my children, to be divided among them, as I shall leave or have living at the time of my decease, and to their heirs and assigns forever, and the representatives of any deceased child to have the share of his, her or their parent.


Third-  If my said wife, Adelaide Applegate, should, in her judgment, consider it for the best interest of my estate to sell the personal property and any or all of the real estate; I hereby give her the authority to sell, either at public or private sale, both the personal and real estate, and I empower her to give good and sufficient deeds in the law for the real estate so sold.


Fourth-  The above bequest to my wife is hereby made and to be by her received in lieu of dower in my estate; and I hereby nominate and appoint her, my said wife, Adelaide Applegate, the sole executrix of this my last will and testament, hereby revoking al former wills by me at any time made.


In witness whereof, I, the said Abijah Applegate, have hereunder set my had, this twenty first day of April one thousand nine hundred and seventeen.

Signed, sealed, published and declared by the above named Abijah Applegate to be his last Will and Testament, in the presence of us, who were present at the same time, and subscribed our names as witnesses in the presence of the testator and each other.
