Will of L.A. Applegate

I, L.A. Applegate make and declare this to be my last will and testament.

1st. I direct that whatever debts I may owe at my death and funeral expenses be paid out of my estate.

2nd. I give to my nieces as follows: Judith Applegate, Mary Kavanaugh, Katherine Kavanaugh and Katherine Wiggins each one thousand dollars. (If Katherine Wiggins should marry before I die she is to receive only seven hundred and fifth [sic] dollars). I give to Maude Applegate, Grace Applegate, & Hallie Applegate each Five hundred dollars. I give to Anna K. Bond One thousand dollars. To Effie W. Wright Seven hundred and fifty dollars. Judith Carlock & Susan Corp each three hundred and fifth [sic] dollars. Allie Woolery, Katherine Arnold & Louisa Meek each Two Hundred and fifth [sic] dollars.

3 I give to my nephew J.L. Wiggins Five hundred dollars for his faithfulness to his mother after his Fathers death.

4 I give to the M.E. Church South at Falmouth KY. one thousand dollars [T]his is to be placed at interest and proceeds from same to be paid on Pastors Salary until repairing or building of a new Church is necessary than said amount to be used for that purpose.

5 I give to the Weslyian [sic] College at Winchester Ky. Five hundred Shares ($1.00 each) of stock in Lexington Oil Corporation. I direct that Fifty dollars be placed in the savings department of the “Pendleton Bank” and interest from same to be paid to the sexton of the Falmouth Cemetery Co. each year for taking care of my lot and graves in said Cemetery.

6 I appoint my brother Leslie T. Applegate executor of this will and request he be permitted to act without bound and be given full power to sell and convey any real estate I may own at my death.

7 If Judith Applegate should die before I do the amount name to her in this will shall be divided equally between Anna Bond, Effie Wright, Judith Carlock and Susan Corp.

8 I direct that a marker be placed at my grave like the one at my wifes grave with the following inscription. Lewis A.A. Sept. 24 1848.

[Codicil]
Since the writing of this will Katherine Kavanaugh has married and is now Katherine Kavanaugh Cahill. I direct from the amount named to said Katherine Kavanaugh in this will enough be taken and given to Judith Carlock and Susan Corp (Also named in this will). a sufficient amount to make the three equal.

If Mary Kavanaugh should marry before I die, I direct that the amount named to her in this will, enough shall be deducted from it and given to Judith Carlock, Katherine Cahill & Susan Corp to make the four equal.

The 500 Shares of stock in the Lexington Oil Co. named in this will has been taken over by the Crump Oil & Gas Co. of Lexington Ky. and certificate of stock issued Dec. 17, 1919. I direct this is to be given in the same way as former was given.

If my brother Leslie T. Applegate should die before I do I appoint my niece Maude Applegate my Executrix without bond. This 6th of July 1921.

In this codicide [sic] which becomes a part of this will I make these changes in the above will. I direct the amount of One thousand dollars named to Judith Applegate be changed to Fifteen hundred dollars & the amount named to Mary Kavanaugh of One thousand dollars be changed to Five hundred dollars. If my estate should fall short of the amounts named to each individual then each one is to bear their promota [sic]of the shortage. But nothing is to be deducted from the amount to the Methodist Church. If there should be a residue after the division is made to the amount of two or three hundred dollars. I direct it be fiven [sic, probably a copyists’s error] to William & Sally Wiggins’ three girls, Mary Casey Wiggins, Margaret & Josephine equally. If it amounts to more than 300.00 I direct my executors to place it were he things it the worst needed. This the 20th of April 1921.

March Term, March 3 1924

The foregoing instrument of writing purporting to be the last will and testament of L.A. Applegate deceased was on this day filed, with two codicides [sic] which were also filed. Said will and codiciles [sic] were in the handwriting of the deceased, and so proven by the oath of Chas. W. Thompson, whereupon, it is ordered that said instrument of writing together with the codicles [sic] be and the same is hereby allowed and establised as and for the last will and testament of said decedent and as such it be admitted to record.
