In the name of God, Amen. I Joseph B. Applegate of the township of Dover in the County of Ocean and State of New Jersey being of sound mind memory and understanding for which blessing I thank God, do make and publish this my last will and testament in manner following that is to say:

First It is my will and I do order that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease.

Item I give and bequeath unto my beloved wife Harriet Applegate if living at my death the sum of three hundred dol1ars to be paid to her by my executors hereinafter named, within one year from my decease.

Item I give and devise unto my son William H. Applegate the following tracts of land and real estate to him his heirs and assigns forever viz: a tract of land conveyed by Ralph B. Gowedy and wife to me Joseph B. Applegate by deed bearing date the thirteenth day of January A.D. Eighteen hundred and sixty nine and recorded in the Ocean County Clerks Office in Book 47 of Deeds pages 389 etc. situate in the township of Dover County of Ocean and State of New jersey containing one acre and sixty two hundredths of an acre Also a tract of land and real estate situate in the township and county and state aforesaid on the south side of and adjoining Walnut street and on the north side of and adjoining James street about one mile in a northerly direction from the court house in the Village of Toms River and being the same as contained in a deed from Ralph B. Goddy and wife to me Joseph B. Applegate dated the tenth day of October A.D. Eighteen hundred and sixty eight containing five acres and two one hundredeths of an acre provided that my three sons Ebenezer Applegate, Oliver P. Applegate and Winfield S. Applegate have the privilege of raising and harvesting two crops on this tract of land and taking away the same after my decease viz: one crop of corn and one crop of wheat.

Item I give and devise unto my three sons Ebenezer Applegate, Oliver P. Applegate and Winfield S. Applegate the following mentioned tracts or parcels of land and premises to them their heirs and assigns forever share and share alike, viz: a tract of land conveyed by Jacob A. Oakerson and wife to Joseph B. Applegate by deed dated the sixth day of June A.D. 1879 and recorded in the Ocean County Clerks Office in Book 99, pages 301 etc. situate in the township county and state aforesaid on the west side of the public road leading from Toms River to Bricksburg and containing twenty five acres and 55/100 of an acre A tract of land being part of a tract of land conveyed to James G. Gowedy and R.B. Gowedy by John Anmack and wife and conveyed by Belah Felsch and wife to me Joseph B. Applegate by deed dated the twenty ninth day of May A.D. 1874 and recorded in the Ocean County Clerks Office in Book 77 of Deeds pages 245 etc after deducting out of the above a tract of land conveyed by me to Sarah Havens by deed bearing date the eighth day of June A.D. 1874 there remains twelve acres more or less which said tract of twelve acres is situate in the township County and State aforesaid and along the road leading from Toms River to Bricksburg.

Item I give and devise unto my two sons Joseph W. Applegate and Bartholomew Applegate the following described tracts of land and premises to them their heirs and assigns forever share and share alike viz: a tract of land situate in the township county and state aforesaid being a tract of fifty acres devised by Ebenezer Applegate to Moses Applegate and Ebenezer Applegate by his last will and testament. Being part of the southernmost fifty acres lying to the east of the gully branch that runs through to Ivins Wilburs northernmost line of his farm reference being had to the said last will and testament, the same, will more fully and at large appear. Also being part of the same premises described in a deed of conveyance from Ebenezer Applegate to Joseph B. Applegate aforesaid bearing date the eleventh day of April A.D. Eighteen hundred and sixty and recorded in the Ocean County Clerks Office in Book 19 of Deeds pages 31 etc. Also all the land and real estate situate lying and being in the township county and state aforesaid which belongs to me lying south of the highway road leading from Cedar Grove to Barnegate Bay.

Item I give and devise unto my six sons Joseph W. Applegate, Ebenezer Applegate, Bartholomew Applegate, Oliver P. Applegate, William H. Applegate and Winfield S. Applegate all the following land and premises viz: all the balance of the lands and real estate which I own and which is not herein above devised whatsoever and wheresoever to them their heirs and assigns forever share and share alike.

Item I give and bequeath unto my three sons Ebenezer Applegate, Oliver P. Applegate and Winfield S. Applegate my sloop boat share and share alike.

Item I give and bequeath unto my son Ebenezer Applegate all my horses cows hogs wagons harnesses and farming utensils of all kinds and description.

Item I give and bequeath unto my son Ebenezer Applegate and my two daughters Alice A. Applegate and Mary M. Applegate share and share alike all my house hold goods furniture and cooking utensils of whatsoever kind or description to have and to hold during the life of my daughter Amelia Applegate and after her death they can distribute them or any of them if they desire to do so to my two daughters Henrietta Page and Sarah Havens as they see fit.

I hereby appoint my son Ebenezer Applegate and Mary M. Applegate guardians of my said daughter Amelia Applegate.

Item I give and bequeath to my four daughters Henrietta Page, Sarah Havens, Mary M. Applegate and Alice A. Applegate the sum of three hundred dollars each to be paid to them by my executors hereinafter named, within one year from my decease.

Item I give and bequeath unto my six sons Joseph W. Applegate, Ebenezer Applegate, Bartholomew Applegate, Oliver P. Applegate, William H. Applegate and Winfield S. Applegate one hundred dollars each to be paid to them by my said executors within one year from my decease.

After paying all my just debts funeral expenses and legacies herein before mentioned I do order and it is my will that my executors hereinafter named put all the balance of my personal property at interest and pay the interest yearly to said Ebenezer Applegate and Mary M. Applegate for the maintenance of my said daughter Amelia Applegate, during her natural life and after her death to pay her funeral expenses out of said personal estate.

Item I give and bequeath to my said wife Harriet Applegate in addition to what is hereinbefore bequeathed to her the sum of two hundred dollars to be paid to her by my said executors within one year after the death of my said daughter Amelia Applegate if my said wife is living at that time.

Item I give and bequeath to my four daughters Henrietta Page, Sarah Havens, Mary M. Applegate and Alice A. Applegate in addition to what is herein before bequeathed to them the sum of three hundred dollars each to be paid to them their heirs or assigns within one year after the death of my said daughter Amelia Applegate.

Item I give and bequeath unto my six sons Joseph W. Applegate, Ebenezer Applegate, Bartholomew Applegate, Oliver P. Applegate, William H. Applegate and Winfield S. Applegate in addition to what is herein before bequeathed to them all the balance of my personal estate share and share alike to them their heirs and assigns to be paid to them by my said executors within one year from the death of my said Daughter Amelia Applegate.

Lastly I hereby appoint my beloved sons Joseph W. Applegate and Bartholomew Applegate and my trustworthy friend John H. Gulich executors of this my last will and testament.

In witness whereof I have hereunto set my hand and seal this thirteenth day of March A.D. Eighteen hundred and eighty one.
