Brooke County West Virginia Will Book 6, pp. 142-43

I, L. C. Applegate of Brooke County West Virginia do make this my last will and testament hereby revoking all other wills by my at any time made.

ITEM 1st. I direct my executor hereinafter named to pay all my just debts and funeral expenses, and I direct said Executor to purchase a burial lot in Franklin Cemetery and have my remains buried therein and I further direct him to erect a Monument at my grave at a cost not to exceed ___ - or about six hundred dollars.

ITEM 2. - I give and bequeath to the Board of Directors of Franklin Cemetery Association in Brooke County, West Virginia, on the grounds of which Company or Association are on the Wellsburg & Washington Turnpike road the sum of Five hundred dollars to be use_ by said Board in the erection of an Iron fence with concrete posts along the said Turnpike road, said fence to be extended along the Old Franklin grave yard as far as the said fund will build said fence. Said fence to be not less than 6 feet high with concrete posts not less than four feet deep in the ground. The fence must not be a wire fence.

ITEM 3. All the residue of my estate of whatever character, Real personal and mixed I give and devise to my wife Emily B. Reeves Applegate.

ITEM 4. If my personal property shall not be sufficient to pay all my debts and pay the expense of Cemetery lot, Monument and bequest to Franklin Cemetery Association, I direct my executor hereinafter named to sell so much of my farm in Cross Creek and Buffalo District in Brooke Count, W. Va on said Turnpike road as may be necessary to pay said debts and raise the funds for said purposes.

ITEM 5. I name J. F. Cree Executor of this my will.
