In the name of God, Amen. I Ebenezer Applegate of the township of Dover, County of Ocean, and State of New Jersey, being of sound mind, memory and understanding (for which blessing I thank God) do make and publish this my last will and testament in manner following: that is to say,

First it is my Will and I do order that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease

Item I give and bequeath unto my beloved wife Sarah Applegate so much of my house hold goods and furniture as she thinks is sufficient for her use, also two cows, such as she shall see fit to choose from my flock; and in case she should die or marry I then order the same to be equally divided among my four daughters, share and share alike. I also give and bequeath unto my beloved wife in lieu of her right of dower in my estate both real and personal the equal undivided one half part of the Homestead farm whereon I now live (not including the part where my son Joseph B. Applegate now lives and which is devised to him and more particularly hereinafter described) to have and enjoy with all the privileges thereunto belonging and in case she should die or marry then I give and bequeath the said part of the Homestead farm unto my son John James Applegate, to him, his heirs and assigns forever.

Item I give and bequeath unto my son Apollo Applegate ten dollars to him his heirs and assigns, forever

Item I give and bequeath unto my son Salem Applegate the tract of land lying around the old field at my meadows, Quit claimed to me by Samuel C. Applegate and John F. Applegate, I also give and devise unto my son Salem Applegate, the equal undivided one half part of a tract of Pine land owned by Samuel C. Applegate and myself (the above mentioned tracts lie on the Foster Patent) to him, his heirs, and assigns forever. I give and bequeath unto my son Joseph B. Applegate the land on which he now lives.

Beginning at a large stone being the third corner of the place on which I now live Thence East thirty chains, 2d south 20 W ten chains. 3d South 85 W five chains and fifty links 4th South 58 W four chains and fifty links 5th North 86 W five chains and fifty links 6th South seventeen chains and fifty links to Toms River 7th along the said River southwesterly to the south east corner of a coal dock 8th west along the south side of the said Coal Dock to the south west corner there of, 9th westerly the several courses of the River until the line intersects with the east line of the farm now owned and possessed by Washington McKean (known as the Brick tract) 10th north along the east line of the said Brick Tract twenty eight chains more or less (not including thee and a half acres conveyed heretofore to Phineas Page) together with the improvement thereon, to him his heirs and assigns forever.

Item I give and bequeath unto my two sons Ebenezer Applegate and Moses Applegate, the following mentioned tracts of land. First, the place where I formerly lived containing thirty acres more or less. Second, the two tracts of land containing fifty acres each, more or less. Third one tract of land containing eighteen acres more or less, the three last mentioned tracts of land lie around the thirty acre tract above mentioned; fourth a tract of Pine land and Cedar swamp beginning at the Elizabeth Spring, containing thirty acres together with the improvements thereon, share and share alike, to them, their heirs, and assigns forever

Item I give and bequeath unto my son John James Applegate the remaining undivided one half part of the Homestead farm on which I now live to have and enjoy with all the improvements thereon, to him, his heirs and assigns forever

Item I give and bequeath unto my five sons Salem, Ebenezer, Joseph, Moses and John James Applegate my Salt Meadow lying at the old cove, to be equally divided among them, share and share alike, to them, their heirs and assigns forever.

Item I give and bequeath unto my daughter Angeline Dunham wife of Samuel C. Dunham the sum of four hundred dollars to be paid in twelve months from my decease to her, her heirs and assigns, forever.

Item I give and bequeath unto my daughter Amanda James wife of William I. James the sum of four hundred dollars to be paid in twelve months after my decease, to her heirs and assigns forever

Item I give and bequeath unto my daughter Helena Smalley widow of Isaac C. Smalley the house and lot where she now lives, together with the sum of fifty dollars (the money to be paid in twelve months from my decease) to her, her heirs, and assigns forever

Item It is my will and I do order my Executors to sell all my other personal property which I have not already devised, also, the following mentioned tracts of land for and toward the payment of the several debts and legacies herein before devised. First, the lot known as the Samuel Applegate lot, Second, the Timothy Page lot of Cedar Swamp, containing five acres Third>, the equal undivided one half part of a tract of Cedar Swamp owned by Samuel C. Applegate and myself and joins the Timothy Page lot, Fourth, a tract of Pine land containing fifty acres beginning at Elizabeth Spring, Fifth, a tract of seventy five acres beginning at Elizabeth Spring and joins lands of Joseph Johnson on the East.

Item In case my personal Estate and lands should not be sufficient to pay the debts and legacies herein before bequeathed, I then charge my Real Estate herein before devised to my five sons, Salem, Ebenezer, Joseph, Moses and John James Applegate with the same and order so much thereof from time to time to be sold by my said executors as will meet the payments of the same.

Item In case my personal Estate and lands shall be more than sufficient to pay the debts and legacies, herein before bequeathed, the remainder and residue, I do order my Executors to place at Interest, which said Interest I do order to be paid to my beloved wife as it becomes due, if the Interest should not prove sufficient for her wants, I do then order my Executors to relieve her wants from time to time from the principal, and at her decease, if any remains, I do order the same to be equally divided between my four sons Salem, Ebenezer, Moses and John James Applegate, to them, their heirs and assigns forever.

Item and lastly, I hereby appoint my friend James I. James and my son John James Applegate executors to this my last will and testament, hereby revoking all former Wills which I may have made

In witness whereof I have hereunto set my hand and seal this sixth day of April in the year of our Lord One thousand eight hundred and fifty three (1853).
